APC fights court order on Atiku’s Tinubu suit, read details
The ruling APC has rejected a court order allowing Atiku Abubakar to serve President Bola Tinubu with court documents through the party’s secretariat.
The APC has rejected a Federal High Court order allowing former Vice President Atiku Abubakar to serve President Bola Tinubu with court documents through the party’s national secretariat. The order relates to a suit filed by Atiku and a co-plaintiff challenging Tinubu and the APC’s eligibility to participate in the 2027 presidential election.
The APC argues that the substituted-service order was unnecessary because Tinubu had already engaged legal counsel, obtained the court documents and filed both a preliminary objection and a full defence. According to APC National Secretary Surajudeen Basiru, these documents were served on Atiku’s lawyers before the application for substituted service was made.
The underlying case concerns allegations by Atiku and the ADC that Tinubu submitted a forged NYSC discharge certificate to INEC and should therefore be disqualified from the 2027 presidential election. These are allegations contained in the suit, not established findings. The court has adjourned the matter until September 28, when the case is expected to come up for mention.
